A RESOLUTION FOR AN EXEMPTION FROM THE PUBLIC CONTRACT COMPETITIVE BIDDING PROCESS FOR CERTAIN PROJECTS AT THE SWEET HOME COMMUNITY CENTER.

WHEREAS, the City of Sweet Home, an Oregon Municipal Corporation, as a Public Agency is constructing the Sweet Home Community Center located at 870 18th Avenue, Sweet Home, Oregon 97386 as a public improvement;

WHEREAS, the parking lot, certain storm drains, utility hookups, and sidewalks at the Sweet Home Community Center need to be improved to City standards;

WHEREAS, Morse Bros. Inc. is a business that regularly deals with cement projects and paving projects and Cascade Timber Consulting Inc. is a forest management business that routinely deals with construction equipment, surveying, tree management, and other land issues; 

WHEREAS, for the benefit to the Community, Morse Bros. Inc. and Cascade Timber Consulting Inc. have offered to donate services, labor, time and materials for grading and paving the parking lot and putting in certain sidewalks, storm drains, and utilities hookups and completing related work at the Sweet Home Community Center;

WHEREAS, the City shall abide by state and federal regulations on paying wages as required by the State of Oregon;

WHEREAS, the City Council is the Local Contract Review Board for the City of Sweet Home;

WHEREAS, ORS 279.015 (2) provides that an exemption from competitive bidding is allowed by a Local Contract Review Board on certain public contracts if it is unlikely that such exemption will encourage favoritism in the awarding of the public contracts or substantially diminish competition for public contracts and the exemption will result in substantial cost savings to the public contracting agency;

WHEREAS, a public hearing was held on April 25, 2000, for the purpose of taking comments on the findings for the exemption from the competitive bidding requirements;

NOW THEREFORE, the City Council for the City of Sweet Home acting as the Local Contract Review Board does hereby resolve and find the following:

1. That Morse Bros. Inc. and Cascade Timber Consulting Inc. are businesses that are competent to do the work set forth above at the Sweet Home Community Center.

2. That the exemption from competitive bidding in this case will not encourage favoritism or diminish competition since Cascade Timber Consulting Inc. does very little business with the City of Sweet Home on public contracts and Morse Bros. Inc. when it does business with the City on public contracts is usually on a sealed bid basis or other bidding basis that provides for the lowest bidder to be awarded the project.

3. That the cost savings to the community of Sweet Home for the Community Center is substantial in that the work specified above would cost approximately $250,000.00 if bid out and it will cost approximately $100,000.00 for materials and labor (to be paid for by others) if done by Morse Bros. Inc. and Cascade Timber Consulting Inc. as stated above.

4. Based upon the above findings the City Council as the Local Contract Review Board for the City of Sweet Home hereby exempts the above referred to public contracts from the competitive bidding requirements for public improvements under ORS Chapter 279.
